Kriptopolis, an independent magazine about
cryptography, security and privacy on Internet, has initiated the "
First Campaign for privacy in electronic communications at
work".
Yesterday, the social hall of the Tribunal Superior de Justicia de Catalunya sentenced in favour of the Deutsche Bank in the
case of an employee who sent over a period of five weeks 140 e-mails not related to work activity.
The controversy about the matter affects many other countries. In Great Britain recently a law was passed that lets firms know
the contents of messages sent by their employees, which has resulted in the reaction of unions and defenders of civil rights.
As far as the legal situation on this topic in Spain is concerned, today a motion by the Socialist group will be presented in the
Senate, which will ask the Government to elaborate a Plan of definite measures that guarantee, efficiently, the right to privacy
and inviolability of communications via electronic mail, both in the working and private fields.
The senator, Félix Lavilla, promoter of the motion, things that the limitations of this right in the working field, are already
included in the Workers' Statutes and the inviolability of telematic communications can only be restricted in cases duly justified
via the opportune Judicial Resolution, which sense the Law for the Protection of Data also manifests.
